An “advance decision” is a decision made a person over 18, with capacity to make the decision that if in future:
  • A particular form of treatment is proposed and
  • At the time he or she does not have the capacity to decide whether to have the treatment or not.
A valid advance decision must be respected and can, if certain requirements are met, include a refusal of life-sustaining treatment.

The Mental Capacity Act sets out the requirements and effects of advance decisions.
